A topic from Work & Money: Employment

In November 2006 my employer agreed that I should be redeployed on health grounds. However, as this was principally to do with mental health and my condition was stabilized, I agreed that there was no urgency as long as I knew that an alternative role was being sought for me. All of 2007 went by and though I had some physical health problems during the year, I did start to become worried that nothing would ever happen.

Earlier this week I was looking through the internal vacancies and I saw a job advertised that really appealed. I sent an e-mail to the HR person dealing with me and today I saw her. She agrees with me that I meet the person specification for the role and because it's on the same grade as my current job, I could be given priority over other applicants. I have to complete a standard application form and then have a standard interview. If the other department likes me, I'll get the job.

This sounds great from my point of view but I'm a little concerned about other people who might have applied for this post already. I was told that if I'm successful, they'll simply get a letter saying that the vacancy has been withdrawn. I really want the job because it sounds very interesting and would resolve my work problems but I'd like other applicants to be treated fairly too.

What are my rights and obligations and what are the employer's obligations, both to me and other applicants?

Rights are to be treated fairly. The employer has the obligation to ensure a fair procedure is followed. They also have an obligation to ensure that you are redeployed to a more suitable role considering your health. It's possible that they may look upon your application more favourable given the circumstances, but they should still ensure a standard procedure is followed. Your obligation really would be to be honest and do your best. Not sure if this helps, but hope it does :)
