Afternoon guys :)

My best mate has just rang me with his knickers in a twist because of a bailiffs letter he received this morning.

His ISP Tiscali, haven't taken a payment since Aug 2006! They haven't sent a single letter or made a single phone call to inform him. There haven't been any disruptions to his service.

He's a busy guy and had a DD setup for the payment of the bill, at the end of each month. For reasons not yet known, it's apparently been failing.

He rang Tiscali to ask them what was going on and why they'd not contacted him or at least cut his service to alert him of a problem. Their simple answer was 'It's not our responsibility to inform you of a payment problem'. Apparently it's the customers responsibility to check ALL of their direct debits every month to ensure they're all going out.

Surely they've been negligent, leaving it 2 fucking years, before any contact has been made?

Any ideas on where he stands legally? I'm so pissed off with the cunts.

tiscali did the same to me a couple of years ago...they failed to take the money from the DD, failed to inform me or write to me...they just sent the bailiff....even the bailiff thought that they had made a mistake in not contacting me....

tell your friend to contact the bailiff, tell them whats been going off, also get them to go see the CAB....but if the bailiff does turn up at the door ...refuse him admission....dont allow them in to seize goods....

Just pay what for what he's used, terminate the contract and switch to a different supplier. If it's two years since he started, he'll be out of contract anyway. No point geting het-up about stuff like that, just sack them off.

I am not sure about the legal issues, but if he can't pay up and the bailiffs show up, MAKE SURE HE DOESN'T LET THEM IN, because he is not obliged to do so. See this page from the CAB for more info.

Well that's an option. And if legally that's his only choice then he'll have to do it. But then having to struggle financially because of what I believe is their mistake, seems unjust.
