Some housing advise please

I live in a shared house. There are normally 3 tenants but there are only two of us at the moment. I think we're on a joint contract but I'm not sure. I've got two problems: firstly, my flatmate has moved all of his stuff into the empty room and is making no attempt to help me to find a third tenant. Secondly, and more importantly, he has not paid his rent for 2 months and now the housing agency are sending threatening letters adressed to both of us, even though my rent is totally up to date. My question is this: are the agency entitled to take action against both of us? Does the fact that it's a joint contract mean that I'm in trouble as well, even though I don't owe the agency any money? I coudl do with some serious advice as I'm getting a bit worried about this. |
