Disclosure of criminal convictions for insurance

Seeing another topic about home insurance has reminded me of a question raised by a friend the other day.

They are looking to renew their house insurance, and in getting quotes the companies are asking something like 'have you EVER been convicted of ANY offence, other than a motoring offence?'.

This raises a number of questions:

• do the company have a right to ask this general question? If it was a question asking about convictions for fraud, theft, dishonesty or the like then I can see the relevance, but I fail to see the relevance of disclosing some (long spent) conviction for, say public affray, or whatever.
• will the insurance companies be able to check convictions in any case? With CRB checks for employments/volunteering there is a set process that has to be adhered to and only the individual can initiate that process.
• Even if they did subsequently find out about an old conviction that had nothing to do with the insured's honesty (eg the public affray conviction) could they invalidate the insurance?

Isn't it rather the case that as a 'service provider', they can ask what they like and if you find the questions intrusive you're left to go elsewhere? I'm thinking that asking this would be a nice exit-clause for them to employ to avoid shelling out, should the need arise.

My advice - find another insurer.
